Modification or Non-Payment of Child Support and Alimony

When a couple divorce, they usually come to a mutual agreement on all of the basic issues. Their agreement is then put into writing and becomes a judgment of the court (divorce decree). As time goes by, circumstances can change, and the parties' may need to modify the terms of the initial divorce agreement. At the law office of Diane W. Alimony, Custody, and Child Support Modifications

Following a divorce, incomes change, needs change, families change, and locations change. When the divorce document becomes outdated and no longer relevant, a modification is in order. Following a divorce, you have the right to modify child custody, child support, and alimony in certain circumstances. Modifications may be made if there has been a significant change of circumstances such as: increased or decreased earnings of either spouse; changed developmental needs of children or financial needs of either spouse; a relocation; or other significant change which makes the terms of the original divorce decree unfair.

Filing Contempt for Non-Payment

If one individual is not paying what the court has ordered them to pay, I will file a complaint for contempt. The rights to child support according to the divorce documents will be enforced. The consequences are serious for those who choose not to pay their obligations to their children, including incarceration or the loss of a driver's license.
