Child Support Issues
Massachusetts uses a formula to determine the amount of child support to be paid. However, there are exceptions to those child support guidelines. At the law office of Diane W. Spears in Boston, Massachusetts, I work to ensure that my clients are paying or receiving fair and appropriate child support.
Child Support Guidelines
The formula is based on income, the number of children, and medical insurance premiums. While the calculations are fairly standard, there are certain exceptions, such as when the parties have joint physical custody, if the joint earnings are over $135,000, or if one individual earns over $100,000. With those exceptions, the goal of child support is to avoid a significant disparity in lifestyle between the two homes.
Child support is not deductible to the payor and thus is paid with after-tax dollars. Being able to claim the child as a dependent can ease the tax burden somewhat.
Non-Payment of Child Support
